  1. General Terms and Definitions

These Terms and Conditions apply to browsing the Site, interacting in any way with it, or using in any manner the content and functionalities of the Site, including making reservations and purchasing travel services through the Site.

The Client can be any natural person who has free access to the site and can make a reservation.

The romantic-venice.com site is not a reseller site.

This site is owned by a private individual, a citizen of the European Union.

Content includes all information on the site that can be viewed using electronic equipment; the content of all actions performed by the Client/Visitor and any other means of communication available.

Content also includes the following:

  1. all information displayed on the website, accessible via an electronic device;
  2. the content of any communications, including emails, sent to the Client/Visitor by romantic-venice.com;
  3. the information transmitted to the Client/Visitor by any means of communication to or from romantic-venice.com;
  4. any data or confidential information about Romantic Venice.

Order refers to an electronic document used as a means of communication between Romantic Venice and the Client, expressing the intent to purchase services from the site.

Using the site by the Client/Visitor implies tacit and unconditional acceptance of these terms and conditions, along with all consequences resulting therefrom.

Romantic Venice reserves the right to modify and update these terms and conditions without prior notice and without specifying the reasons.

The following terms and conditions represent a contractual agreement between Romantic Venice, hereinafter referred to as the Provider, and the Client/Visitor.

Clients/Visitors are advised to read the terms and conditions carefully.

  1. Personal Data Protection

Personal data protection applies regardless of the method used for processing the personal data, and regardless of the form, storage medium, type, or nature of the documents containing such data.

Definitions:

  • “Special categories of personal data” means personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data used for unique identification of a natural person, health data, or data concerning a person’s sex life or sexual orientation.
  • “Sensitive personal data” means the special categories of personal data of the data subjects.
  • “Personal data” means any information relating to an identified or identifiable natural person; an identifiable person is one who can be identified, directly or indirectly, by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more elements specific to their physical, physiological, genetic, mental, economic, cultural, or social identity.
  • “Personal Data” refers to the personal data of the data subjects processed by Romantic Venice, on its behalf or independently, when such data is collected and/or made available to third parties on behalf of Romantic Venice.
  • “Service Providers” means entities processing personal data on behalf of Romantic Venice.
  • “Information Notice” means the notice provided by Romantic Venice to data subjects in accordance with the Regulation.
  • “Data Subjects” refers to clients, employees, suppliers, and any other individuals who come into contact with the hotel, either directly or through third parties acting on behalf of Romantic Venice, whose personal data is processed by Romantic Venice.
  • “Processing” means any operation or set of operations performed on personal data or sets of personal data, with or without automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment or combination, restriction, erasure, or destruction; “processed” or “processing” shall be interpreted in accordance with this definition.
  • “The Regulation” means Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons regarding the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the “General Data Protection Regulation” or “GDPR”).
  • “Third party/Parties” means a person or entity other than the Hotel, its employees, collaborators, or service providers, with whom the Hotel interacts.
  • “Transfer”, “to transfer”, “transferred” in relation to personal data means any transmission, availability, disclosure, or other method of making such data known to another person than the one currently holding it, regardless of the means by which it is carried out (e.g., physical or electronic).

Personal data processing is subject to several general rules and principles. Understanding and applying these principles allows us to fulfill our responsibilities related to personal data protection as processed by romantic-venice.com.

Personal data must be processed lawfully and fairly.

  • Right not to be subject to automated decision-making – The data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them.

Romantic Venice undertakes to process personal data in compliance with the principles established by the GDPR, particularly:

  • Purpose limitation – data shall be collected for specified, explicit, and legitimate purposes and not further processed in a manner that is incompatible with those purposes;
  • Data minimization – data shall be adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed;
  • Accuracy – data must be accurate and, where necessary, kept up to date;
  • Storage limitation – data shall be kept in a form which permits identification of data subjects for no longer than is necessary;
  • Integrity and confidentiality – data shall be processed in a manner that ensures appropriate security.

Romantic Venice implements appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage.

Given the above, in order to enable communication between Romantic Venice and the Client/Visitor on the website romantic-venice.com, it is necessary for you to agree that we may collect and process the data requested from the Client/Visitor in accordance with Regulation (EU) 2016/679.

The personal data provided to the Provider will be used solely for the stated purpose of this website. We respect and guarantee the confidentiality of the data voluntarily provided by the Client or Visitor.

Romantic Venice, as the Provider, recommends that all Visitors/Users carefully read this document in order to avoid any potential issues that may arise from using and/or purchasing services offered by the Provider through the website romantic-venice.com.

Withdrawal of consent regarding the Terms & Conditions of the website romantic-venice.com cannot be exercised during the course of a contract or until all financial obligations to Romantic Venice have been fulfilled, including any penalties, if applicable, according to the cancellation or no-show policies specified in this document.

  1. Purpose and Disclaimer of Liability

The website romantic-venice.com  and the information it contains are provided by us solely for informational purposes. By providing this information, we do not undertake to offer advice of any kind. The information presented on the site is based on sources considered accurate and reliable, and we have taken reasonable steps to ensure the correctness of the information published on the site.

Romantic Venice does not guarantee the technical or functional quality of the website or the absence of viruses that may exist on it. Romantic Venice shall not be held liable for any direct or indirect damages suffered or claimed by the user resulting from malfunctions of the romantic-venice.com website.

  1. Making Reservations

Reservations for services offered by Romantic Venice can be made through the following methods:

  • Using the online booking platform by accessing the “BOOK NOW” section on the romantic-venice.com website;
  • By phone, by calling the contact number;
  • By sending a written request to the email address reservations@romantic-venice.com.

For reservations made by phone, the availability of the apartment is checked in advance, and the client is invited to send a written request by email or to complete the booking via the online platform.

The reservation is confirmed once the full payment for the stay is made.

If the client does not show up at the apartment, the entire amount for the stay will be retained.

The hotel places great importance on the processing of personal data, so the processing of data required during the card pre-authorization procedure is done in compliance with the privacy policies detailed in the dedicated section on the website.

By law, the minimum booking duration is 2 nights.

  1. Payment and Guaranteeing Reservations

Payment for accommodation services can be made using the following methods:

  • By bank transfer, according to the details specified in the email;
  • Online payment using VISA cards (including Electron) and MasterCard (including Maestro).

A reservation becomes guaranteed once the payment is confirmed.

For reservations made by phone or email, guaranteeing the reservation requires full payment of the stay within a maximum of 2 days from the receipt of payment details. If payment is not made within this period, the reservation will be automatically canceled.

For reservations made through the online platform, the reservation is guaranteed by entering the bank card details in the booking form and the full amount for the stay is retained.

The client is responsible for the accuracy of the data entered in the booking form. Romantic Venice cannot be held liable for errors made by the client that are reflected in the reservation.

  1. Guarantees

Romantic Venice does not require advance deposits from clients; however, if upon leaving the apartment Romantic Venice finds that the client caused damage or in any way deteriorated the apartment, the client agrees to pay the value of these damages to Romantic Venice afterwards.

  1. Changes, Cancellations, No-Shows, and Penalties

Any request to modify or cancel a reservation by the client must be communicated in writing to the email address reservations@romantic-venice.com. Changes are only possible with the prior approval of Romantic Venice.

The cancellation conditions are as follows:

  • Cancellation made at least 5 days before the check-in date does not incur any penalties;
  • Cancellations made less than 5 days but more than 24 hours before arrival incur a penalty of 50% of the total booking value;
  • Cancellations made less than 24 hours before the arrival date incur a penalty of 100% of the amount paid.

Failure of the client to show up at Romantic Venice on the agreed check-in date, without prior notice, results in the full retention of the advance payments made.

If the client decides to shorten the stay after arrival, Romantic Venice reserves the right to retain, as compensation, the value of the unused nights.

  1. Check-in & Check-out

The accommodation process begins at 4:00 PM on the day of arrival.

Check-in is performed before the client’s self check-in via the national platform www.mymaisonapp.com The client’s identity will be verified by Romantic Venice.

The room must be vacated no later than 11:00 AM on the day of departure.

  1. Pets

Pets are accepted free of charge. Clients assume full responsibility for any damage caused by their pets. Additionally, clients are responsible for the safety and health of the pets they bring into the Romantic Venice premises.

  1. Smoking

Smoking is strictly prohibited inside Romantic Venice, except in specially designated and marked areas. Failure to comply with this policy may result in financial penalties or other disciplinary measures in accordance with the hotel’s internal regulations.

  1. Parking Area

Romantic Venice offers guests a free private parking area with a capacity of 4 spaces to ensure the safety of vehicles.

  1. Safety. Special Needs

For more information on how personal data is protected, please consult the Personal Data Processing Notice available on the website Romantic Venice does not assume responsibility for items forgotten, lost, or allegedly stolen on its premises.

Additionally, Romantic Venice cannot be held liable for accidents that may occur as a result of improper use of equipment or facilities available on the premises.

Guests with special needs or specific requirements are kindly asked to inform the hotel in advance to benefit from appropriate support and accommodations within the limits of possibility.

  1. Environmental Protection & Cleanliness

Romantic Venice pays special attention to environmental protection by adopting measures aimed at reducing negative impacts on the environment.

  1. Conduct and Responsibilities

Clients are directly responsible for any damages caused to other guests, staff, furniture, or equipment belonging to Romantic Venice.

  1. Complaints

Complaints regarding the quality of tourist services may be made during the stay either directly at Romantic Venice or by email at rezervari@hotelsimonahalep.ro.

Complaints submitted after the end of the stay may also be sent by email. However, complaints regarding issues that could have been resolved during the stay will not be considered afterwards.

  1. Force Majeure

Force majeure relieves the party invoking it from liability, in accordance with the provisions of the Civil Code. Force majeure is any external, unforeseeable, absolutely invincible, and unavoidable event, while a fortuitous event is an event that could not be foreseen or prevented by the party liable if the event had not occurred.

The party invoking force majeure must notify the other party in writing within a maximum of 5 (five) days from its occurrence, and proof of force majeure must be communicated within 15 (fifteen) days from its occurrence. The party invoking force majeure must notify the other party of the cessation of the cause within a maximum of 15 (fifteen) days from the cessation.

  1. Disputes

Any dispute arising between the Client and the Provider shall be resolved amicably by agreement between the two parties. If this is not possible within 30 days, the jurisdiction lies with the Italian courts where Romantic Venice is located.

If any clause of this Document is declared null or invalid, this shall not affect the validity of the other clauses.

Romantic Venice shall not be held responsible for any losses, costs, lawsuits, claims, or expenses that may arise from the client’s failure to comply with the Terms and Conditions.

  1. Final Provision

The Provider reserves the right to make any changes to these provisions, as well as any changes to the romantic-venice.com website, its structure, or any other modifications that may affect the site, without prior notification to visitors or clients.

The Provider shall not be liable for any errors appearing on the Site for any reason, including those caused by modifications or settings not made by the Site administrator.
